Politico Hypes Up 'Hillary FBI NIghtmare'

The only nightmare is their biased reporting. This headline is made to sound as ominous as possible: Hillary's FBI Email Nightmare.

As David Brock urges Hillary supporters the first rule of engagment is no bedwetting. If you look at this Politico is as usual over-hyping this. 

"The next question in the Hillary Clinton email matter is who will force the FBI to release any documents it may have retrieved from the 2016 presidential candidate's homemade server — Congress or the courts?"

The question begs: why does anyone have a right to these emails as they are private?  Hillary complied more fully with the initial State Department request than any other Secretaries of State-Colin Powell, Condeeleza Rice, Madeline Albright, but of course Trey Gowdy and the NY Times' Carolyn Ryan don't want those other SOSs coonskin over their fireplaces. 

As a government official Hillary did the right thing in handing over the relevant emails and getting rid of personal and irrelevant stuff. This is what all such high ranked officials do and she followed the rules in deciding which emails to dispose of. 

Yet there is this move to invade her privacy. 

So even though Politico is trying to frame this as a 'nightmare' the nightmare for the GOP is that the FBI is shutting this down. Remember all the false claim that she is being investigated by the FBI?

"Even as republicans in congress continue to try to turn Hillary Clinton’s fully legal use of email into a scandal, the FBI has made clear that it isn’t having any of it. The State Department and DOJ have already made clear that Clinton violated no laws or policies and did nothing wrong, and now the FBI is declining to be dragged into the partisan fray. The result: a leading republican in congress is now openly attacking the FBI."

Republicans have taken the matter to court in a fairly transparent attempt at highlighting the fact that Clinton has a Muslim on her staff, having fabricated the claim that Huma Abedin was somehow hired improperly so they can get to her email and then attempt to scandalize her. As the legal proceedings go on, the Department of Justice weighed in weeks ago to plainly state that there was no wrongdoing with Clinton’s email and that the suit should be thrown out. But the judge has allowed the proceedings to continue, asking the FBI to weigh in.

But FBI General Counsel James Baker has shut down that request (link here), prompting republican Senate Judiciary Committee Chairman Chuck Grassley to respond by claiming that the FBI is now behaving like it’s “above the law.”

So the news is actually that the FBI is shutting a politically motivated fishing expedition down. Just like with Whitewater the GOP is trying to expand this more or less endlessly-and Benghazi is now the longest investigation ever-Pearl Harbor, JFK's murder, Watergate, 9/11 pale in comparison. 

Of course the difference is those were legitimate investigations and this is just a politically motivated hatchet job to destroy Hillary Clinton-who they all had some pretty nice things to say about back when she was Secretary of State. 

But Politico can't admit this instead they put the words Hillary, email nightmare, and FBI into one sensationalistic headline with the deliberate intention of making Hillary fans panic-maybe some donors will demand that Joe Biden put on his cape and save the day. 

The real headline ought to be about how the FBI has rebuffed Trey Gowdy's fishing expedition and the GOP is now desperate to find a judge that will wrongfully allow them to start nosing into emails that are none of their business.

"The FBI has already rebuffed one judge's effort to obtain messages the agency has recovered from Clinton's server, prompting a stinging attack from Iowa Sen. Chuck Grassley, the Republican chairman of the Senate Judiciary Committee."

So the danger for Trey Gowdy is the wind is coming out of the sails. They need something new

One line of attack of course is to attack Huma Abedim-we know Muslims can't be trusted. But why would a judge help him do that? Maybe a Right wing judge? But the FBI may well rightly refuse to comply.

"Key congressional committees investigating Clinton’s emails argue that the courts are better suited to force the release of federal documents. One GOP source familiar with the investigations said a congressional committee could "theoretically subpoena the FBI" to demand the contents of Clinton's server, but judges are likely to wade into the issue first."

"I think the court is better positioned right now because of where the cases are in litigation," the source said.

"Court action, however, depends on the aggressiveness of federal judges who are now managing more than 30 Freedom of Information Act cases involving emails on accounts maintained by Clinton or her top aides."

Now it bears asking why there are 30 FOIA requests about her emails. The answer is Citizen's United and similar Right wing legal groups have carpet bombed the court system with all these frivolous FOIA requests.

Yet Lawrence O'Donnell can piously demand to know if Hillary Cares about the FOIA.

Well maybe if Lawrence cared about the FOIA he'd realize that CI and friends are abusing it with frivolous requests and that even now there is an obsession with paying the Democrats back for Nixon-after all the FOIA was about the secrecy and corruption of his Administration.

So the real headline is that the email witch-hunt needs a judge to breath new life into it-and even then the FBI may not cooperate which is right as there is no legal basis to demand to see any further emails. Any judge who says otherwise either doesn't know the law or is a Right wing judge giving a political ruling.
