As I've observed, if anything the judge has been more than fair to Trump in postponing a decision until after the election. That's good for Trump but not so good if your one of the 40,000 victims. What are the chances of prevailing against President Trump? They themselves have to hope Hillary wins.
Regarding Trump's slurs against the judge, Hillary has a great response.

I love that. It's a bit coy to mention his German heritage as what might someone who judges by people's heritage infer about Trump? They might find it unsurprising that he keeps a copy of Hitler's speeches locked in a cabinet by his bed.

Fundamentally, Trump is a racist. This is not something to say lightly. But everything we know about him tells you that if President he will set back anti discrimination policy years.

We got a glimpse into his attitude toward citizenship when he called for ending birthright citizenship.
The irony is that Trump's attitude is not American. Being American is not about who your parents or grandparents were or came from. This is the older European idea of citizenship.
Recently he has stated that he will only consider white males as his Vice President. What this amounts to is a vow to discriminate.
I don't have to hire a black person, a woman, or a Latino for every job I'm hiring for. But if I say I won't even consider any such candidates, that's discrimination.
So Trump is telegraphing that he will only choose white males for his VP, cabinet or for judges.
Again, it's wrong to judge people on their ethnic heritage. But if you did, you might say this attitude is not surprising based on Germany's history with racism.
Trump is in many ways running not just against Obama's legacy but also LBJ's. LBJ gave us the foundation of modern civil rights in his major bills-the Voting Rights Act, etc.
Part of his Great Society was civil rights for immigrants and opening up immigration from nonwhite countries, Trump is more or less running as a pre civil rights candidate.

I saw that movie, It is a striking analogy. I remember in the movie everyone was always accusing everyone of being gay.
