Denied! SJC Declines to Hear Ohio Early Voting Appeal

While Romney has made some gains since the debate-which may be dissipating some though today's SEIU poll showed Romney up 50-46 among likely voters-he hasn't been able to take the lead in Ohio.

No Republican has ever won the Presidency without winning Ohio. If Romney will get it this year it won't be by denying early voting and forcing Democratic voters to wait in the kind of lines they did in 2004-some waited 24 hours to vote, which is why Kerry couldn't concede till the next day.

"The Supreme Court has turned aside a request from the state of Ohio to take up an appeal of federal court decision which prevented the state from stopping early voting during the three day period before the election. The decision is a victory for the Obama campaign, which had successfully argued that Ohio could not allow military and overseas voters to vote during the three day period unless that opportunity was available to all voters."

"Secretary of State Jon Husted announced he was appealing the case to the Supreme Court last week, arguing the 6th Circuit Court of Appeals decision didn't make legal or practical sense."

So the fight against early voting is over in Ohio. This year has seen things go well for the Democrats in opposing Republican plans to impede and obstruct voters in most places-though some worry that the ambiguity in places like Pennsylvania could confuse some voters and discourage them from voting.

While there is also some worry about the future, during this cycle the system worked pretty well. No doubt part of the reason for the Ohio GOP's urgency was the huge lead the President enjoys among those who have already voted.
